He assured me of the delivery mode I used. They did not arrive until the day after the required day, and I had to work diligently with the receiver to ensure it would not require me to start a tedious process that had been underway since late November. I understand unforeseen circumstances, but I also believe I should not pay for what was not agreed to and not delivered — I expect I should receive a refund. If there is a possibility/reasonable probability that deliveries might not be on time, that should be made clear explicitly to the customer (e.g., me) up front, not in any mentioned disclaimer.
